The National Health Surveillance Agency (ANVISA) presented new legislation that is under public consultation, so you can say what you think about the proposal.

In addition to maintaining the ban on the trade and import of electronic cigarettes, a decision taken more than 14 years ago that brought many problems to the country, it also seeks to restrict the USE and POSSESSION of these products. This implies the potential criminalization of millions of people.

MAINTAIN THE PROHIBITION OR ALLOW WITH RULES?

The legislation has remained the same for 14 years, a ban on trade that has not worked. Everything that has happened in Brazil is the result of this decision. Indiscriminate use by young people, products without sanitary control, serious illnesses and even a recorded death.

    Misperceptions about the risks of electronic cigarettes are common among Brazilians, mainly because health organizations and even medical professionals are spreading false information in the media, in an ideological campaign that goes against scientific evidence.

    Science has already proven, without a shadow of a doubt, that using an electronic cigarette is not risk-free and is harmful to your health, however, compared to conventional cigarettes, it is much less harmful, being at least 95% less harmful or 20x safer than conventional cigarettes.     ABOUT THE USE BY MINORS

    Electronic cigarettes are part of the Smoking Harm Reduction (RDT) strategy, aimed at adult smokers who are looking for a complete replacement of traditional products, resulting in a significant reduction in harm to health. However, due to the presence of the illegal market, consumption among teenagers in Brazil is very high, unlike what happens in countries that allow controlled trade in these products.

    In 2019 in the United States there were no regulations on electronic cigarettes and an epidemic of consumption among teenagers reached a total of 27.5% of minors having already tried these products. After the controlled permission of commerce, this number plummeted and today less than 2% of young people use it daily.

    ABOUT THE INCREASE THE INSPECTION

    Those who support the ban on the sale of electronic cigarettes in Brazil say that simply increasing supervision will solve the problem.

    This is false. The IRS has been doing a lot of inspection work for years.

    Recent data indicates that, in 2019, seizures of electronic cigarettes totaled R$1.9 million or almost 23 thousand units. However, by October 2023, these numbers had skyrocketed to more than R$53 million or almost 1.2 million units, representing an increase of more than 5,200% in just 5 years.

    Those who lobby against the controlled permission for the sale of electronic cigarettes in Brazil love to use the argument that they are just another product of the tobacco industry, but this is a LIE and an immoral strategy to deceive public opinion!

    Tobacco companies have electronic cigarette products, but they were not the inventors and do not control the market. For all intents and purposes, they do not “own” the products. The dominant player is China, it was there that the electronic cigarette was invented by a pharmacist in 2003. The tobacco industry only started manufacturing products in 2012 and even today it does not hold even 40% of the global market.

    There is no “owner” of the vape, but rather adult consumers who use these products to quit smoking, with great success. The results of countries that are betting on this show that they are alternatives that save lives.

    If anyone should claim anything, it’s the people who are quitting smoking and seeing a huge improvement in their lives thanks to vaping.

    Obviously, cigarette manufacturers are keeping an eye on this market and want to make a profit, it is no surprise that they are investing heavily, but this cannot be a reason to prevent a technology that is saving lives from being available in Brazil.

    SUCCESSFUL STRATEGY IN MANY COUNTRIES

    Harm Reduction (HR) is an advanced public health strategy that supports less harmful alternatives when abstinence is not possible. RD understands that people will do things that are risky or even harmful to their health, whether out of necessity or choice, even if a healthcare professional tells them otherwise.

    When “not doing it” is not an option, “doing it with the lowest possible risk” becomes the best choice.
